PENERAPAN PERLINDUNGAN HUKUM BAGI PEREMPUAN DAN ANAK ATAS KEKERASAN VERBAL DAN NON VERBAL DI KABUPATEN KUTAI KARTANEGARA

Abstract

The integrated service center for the Empowerment of Women and Children in Kutai Kartanegara Regency is an institution that provides services to victims of women and children who experience verbal and non-verbal violence. The services provided consist of legal services in the form of legal services, namely in the form of receiving complaints/reports, making assignments, legal counseling to women and children victims of violence, mediation with parties, assistance to victims to make nearest police reports, accompanying victims of physical violence/immoral cases in making post mortem et refertum in hospitals, assisting in the examination of women and children victims either as victims or children as perpetrators in the police, prosecutors and examinations in temporary courts. Psychological services are provided to help victims of violence get assistance in overcoming one's mental health so lead a good life and have good social relations or psychological problems that are being faced.

Obstacles - obstacles in the implementation of legal protection for women and children for verval and non-verbal violence in Kutai Kartanegara are divided into two, namely internal constraints within the P2TP2A Kutai Kartanegara institution and external constraints outside the institution. What is meant by internal constraints is the lack of adequate human resources or the lack of professional staff providing assistance to victims of violence and the lack of a budget allocated by the government for handling victims of violence against women and children due to the large area. External constraints, namely that victims of violence are still closed who do not want to report violence that occurs in their household because they are afraid of being known by other people or the general public because it is considered a disgrace that cannot be published, and the environment where victims live tends to close access, so cases It just happened without any handling or law enforcement.
