KEWENANGAN MENGADILI SENGKETA HASIL PEMILIHAN DAN HUBUNGANNYA DENGAN GUGATAN PMH PERDATA

Abstrak

The authority of the courts to adjudicate disputes over regional head election results and their relationship to civil tort claims (PMH). Using a descriptive-analytical method, this study outlines the role and jurisdiction of the Elections Supervisory Agency (Bawaslu) and their relationship to the principles of lex specialis and lex generalis. The results indicate that election result disputes must be resolved through a specialized judicial body, not through general courts. This study emphasizes the importance of legal clarity and accuracy in determining the parties and jurisdiction in such disputes.
