TINJAUAN KRITIS KEKUASAAN PRESIDEN TERHADAP POLRI BERDASARKAN TEORI TRIAS POLITICA

Abstract

From the perspective of Trias Politica, the President's authority over the Indonesian National Police (POLRI) can be viewed as part of executive power, exercised while still considering the independence of POLRI in carrying out its functions. The President has the authority to regulate and oversee POLRI policies, but on the other hand, POLRI must also maintain its independence in carrying out its duties, especially those related to law enforcement and protecting civil supremacy. POLRI must operate within the applicable legal framework and not simply follow executive instructions, to avoid abuse of power and ensure that the government process runs in accordance with healthy democratic principles.
