PENATAAN DAERAH PEMILIHAN DAN ALOKASI KURSI DPRD KABUPATEN KUTAI KARTANEGARA PADA PEMILIHAN UMUM TAHUN 2024 BERDASARKAN PRINSIP PROPORSIONALITAS DAN KESETARAAN NILAI SUARA

Abstract

The arrangement of electoral districts and allocation of seats are important elements in ensuring democratic elections that uphold the principles of proportionality and equality of vote value. This study analyzes the arrangement of electoral districts in Kutai Kartanegara Regency in preparation for the 2024 General Election, especially after the establishment of new subdistricts, namely Samboja Barat and Kota Bangun Darat. This study uses a normative juridical research method with statutory, conceptual, and case approaches by examining Law Number 7 of 2017 concerning General Elections and the General Election Commission Regulations related to electoral district arrangements. The results show that the addition of new subdistricts did not increase the number of DPRD seats in Kutai Kartanegara Regency because the population size still falls within the category of 500 thousand to 1 million inhabitants with a total allocation of 45 seats. However, population growth and territorial expansion influenced the redistribution of seats among electoral districts. The first electoral district arrangement proposed by the KPU is considered more consistent with the principles of territorial integrity, continuity, cohesiveness, and proportionality because Samboja Barat remains integrated with its historical and geographical parent district.
