PENYELIDIKAN DAN PENYIDIKAN DITINJAU DARI UNDANG-UNDANG NOMOR 20 TAHUN 2025 TENTANG KITAB UNDANG-UNDANG HUKUM ACARA PIDANA

Abstract

Investigations and inquiries are an important part of the criminal justice system because they are the initial stage in the law enforcement process for a crime. This study aims to determine the legal regulations regarding investigations and inquiries and the authority of investigators and investigators based on Law Number 20 of 2025 concerning the Criminal Procedure Code. The research method used is empirical normative legal research by examining the provisions of laws and regulations and their implementation in law enforcement practices. The results of the study indicate that Law Number 20 of 2025 concerning the Criminal Procedure Code is a form of reform of national criminal procedure law that provides more detailed regulations regarding investigations and inquiries. These regulations include duties, functions, authorities, implementation procedures, coercive measures, and supervision of law enforcement officers. The 2025 Criminal Procedure Code also emphasizes the principles of professionalism, accountability, and due process of law in the implementation of investigations and inquiries to ensure the protection of human rights. In addition, investigators and prosecutors are given the authority to take legal action to uncover crimes, such as receiving reports, seeking evidence, conducting investigations, arrests, detentions, searches, and seizures, in accordance with statutory provisions. However, the exercise of this authority remains limited by legal oversight mechanisms through pretrial proceedings and court oversight to prevent abuse of authority. Therefore, the provisions in the 2025 Criminal Procedure Code are expected to create a more modern, effective, and professional criminal justice system that continues to protect citizens' rights.
