PERAN KARTU INDONESIA PINTAR SEBAGAI JAMINAN INSTRUMEN PEMENUHAN HAK ATAS PENDIDIKAN DALAM PERSPEKTIF HAK SOSIAL BERDASARKAN UNDANG-UNDANG DASAR NEGARA REPUBLIK INDONESIA TAHUN 1945

Abstract

Education is a fundamental right of every citizen guaranteed by the Constitution, particularly Articles 28C and 31 of the 1945 Constitution of the Republic of Indonesia. As a manifestation of the state's responsibility in the field of education, the government launched the Kartu Indonesia Pintar (KIP) or Smart Indonesia Card to assist students from underprivileged families in obtaining proper and quality education. This study aims to analyze the role of KIP in ensuring the right to education and to identify the challenges encountered in its implementation. The research employs a qualitative descriptive method with statutory and conceptual approaches, relying on secondary data from relevant literature and regulations. The findings indicate that KIP plays a vital role as a social guarantee for the right to education; however, its implementation still faces obstacles such as inaccurate beneficiary targeting, weak supervision, and limited educational facilities. Therefore, it is necessary to strengthen coordination, integrate data systems, and conduct regular policy evaluations to enhance the effectiveness of KIP as an instrument for fulfilling the right to equitable and just education for all Indonesian citizens..
