Abstract

Law violations against fanfiction are tentative, which means the extent to which the fanfiction does not violate the economic and moral rights of the original creator. To determine whether a fanfiction violates a copyright violation or not, each case must first be researched because it is examined on a case-by-case basis with a qualitative assessment stipulated by law. Every fanfiction has different purposes of use and different content. Because if we examine carefully, the copyright law accommodates the interest of fanfiction writers to use material from the original work without the author's direct permission with several provisions.

Legal protection provided by law for creators or copyright holders of original works of fanfiction is preventive legal protection and repressive protection where preventive protection is by entering into a license agreement between the creator of the original work and the author of the fanfiction which intends to commercialize the fanfiction work or the author of the work. originals may use a Creative Commons License if the author of the original work wants to prevent the exploitation of his work excessively and without his knowledge on the internet, by setting the terms he wishes to use for the work without having to meet and ask permission in person. With repressive legal protection by way of resolving through arbitration or filing a civil suit to the Commercial Court, criminal reports, and requests for a temporary ruling by the Court to prevent greater loss.
