FUNGSI BALAI PEMASYARAKATAN DALAM MELAKUKAN BIMBINGAN TERHADAP KLIEN ANAK
Abstract
The Children's Correctional Center (Bapas Anak) is a technical implementing unit under the auspices of the Ministry of Law and Human Rights of the Republic of Indonesia. This institution plays a very important role in the activities of guidance, supervision, and assistance for children involved in legal problems (Children in Conflict with the Law/ABH), children with deviant behavior, and civilian children. Bapas Anak has the main responsibility in providing social guidance, supervising clients who are outside the correctional institution, compiling reports on the results of community research (Litmas), and providing assistance in both legal and psychosocial aspects. All of these tasks are carried out based on a number of legal regulations that form the basis for their operations, including Law Number 22 of 2022 concerning Corrections, Government Regulation Number 31 of 1999, Regulation of the Minister of Law and Human Rights Number 3 of 2018, and Decree of the Minister of Justice Number M01-PR.07.03 of 1985.
In practice, Community Guidance (PK) plays an important role in assisting the law enforcement process by compiling Litmas and providing guidance to children who are sentenced to conditional sentences, fines, or those who have received conditional release. Bapas also provides direct guidance to children who are not in the care of parents or social institutions, and carries out a supervisory function for children who are cared for by these parties.
In contrast to Correctional Institutions (Lapas) which focus on fostering prisoners during their detention, Bapas focuses more on the guidance process for correctional clients who have returned to society but are still undergoing a period of guidance. Therefore, the existence of Bapas Anak is very strategic in supporting social reintegration and preventing the repetition of criminal acts (recidivism) in children, with the aim that they can return to living a productive and responsible life as part of society.
